1. Acceptance of Terms
By accessing or using the Molnar Roofing website (molnarroofing.ca), submitting any forms, engaging our services, or communicating with us in any capacity, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
These Terms of Service constitute a legally binding agreement between you ("Client," "you," or "your") and Molnar Roofing ("we," "us," or "our"), a roofing contractor based in Yorkton, Saskatchewan, Canada.
2. Description of Services
Molnar Roofing provides professional roofing and exterior maintenance services throughout Yorkton and Eastern Saskatchewan, including but not limited to:
- Complete roof replacement and re-roofing
- Roof inspections and condition assessments
- Roof repairs (leak repair, shingle replacement, flashing, storm damage)
- Eavestrough (gutter) cleaning and maintenance
- Insurance claims assistance and documentation
- Small home repairs (soffit, fascia, siding, exterior maintenance)
The specific scope of work for any project will be defined in a written estimate or contract provided to you prior to commencement of work.
3. Estimates & Pricing
- All estimates are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated
- Estimates are based on the conditions visible at the time of inspection. If additional damage or unforeseen conditions are discovered during the project (e.g., damaged decking beneath shingles), we will notify you immediately and provide a revised estimate before proceeding with additional work
- Prices quoted include materials, labour, and cleanup unless explicitly noted otherwise
- We reserve the right to adjust pricing if material costs change significantly between the estimate date and project commencement. Any such adjustment will be communicated to you in writing before work begins
- Verbal quotes are approximate only. Only written estimates are binding
4. Scheduling & Access
- Project scheduling is subject to weather conditions, material availability, and crew scheduling. We will make every reasonable effort to adhere to agreed timelines
- Roofing work is weather-dependent. Delays caused by rain, snow, extreme temperatures, or other weather conditions are not considered a breach of contract
- You agree to provide safe, unobstructed access to the work area, including driveways, yards, and rooftop access points
- Vehicles, personal property, and outdoor items near the work area should be moved or protected prior to the start of work. Molnar Roofing is not responsible for damage to items left in the work zone
5. Payment Terms
- Payment terms are outlined in your project estimate or contract and may vary by project size and type
- For larger projects, a deposit may be required prior to ordering materials. The remaining balance is due upon completion of the project
- We accept cash, cheque, e-transfer, and major credit cards
- Invoices not paid within 30 days of the due date may be subject to a late fee of 2% per month on the outstanding balance
- In the event of non-payment, Molnar Roofing reserves the right to register a builder's lien against the property in accordance with The Builders' Lien Act of Saskatchewan
- For insurance claim projects, payment is expected from the insurance proceeds. You are ultimately responsible for any deductible amounts and any costs not covered by your insurer
6. Warranties & Guarantees
- Workmanship warranty: We stand behind the quality of our work. Specific workmanship warranty terms will be provided in writing with your project completion documentation
- Manufacturer warranties: Roofing materials carry their own manufacturer warranties, which vary by product. As a BP Weather-Tite Gold Certified contractor, we can offer enhanced manufacturer warranty coverage on qualifying products
- Warranty limitations: Warranties do not cover damage caused by acts of nature (hail, windstorm, tornado, falling trees), unauthorized modifications or repairs by others, failure to maintain the roof (e.g., allowing debris accumulation), or normal wear and tear
- To make a warranty claim, contact us directly. We will inspect the issue and determine whether it falls within the warranty scope. Legitimate warranty claims will be repaired at no additional cost to you
7. Insurance Claims
- We offer assistance with insurance claims as a service to our clients. However, we are not insurance adjusters, brokers, or legal representatives. Our role is to provide professional documentation and communicate with adjusters on your behalf
- We cannot guarantee the outcome of any insurance claim. The final determination of coverage and payout is made solely by your insurance company
- You are responsible for understanding the terms of your own insurance policy, including deductible amounts, coverage limits, and filing deadlines
- We will not advise you to misrepresent damage or file fraudulent claims under any circumstances
8. Client Responsibilities
As a client of Molnar Roofing, you agree to:
- Provide accurate and complete information about your project, property, and any known conditions
- Ensure proper access to the work area as described in Section 4
- Inform us of any underground sprinkler systems, buried cables, septic tanks, or other hidden hazards near the work area
- Obtain any necessary permits or approvals required by the City of Yorkton or your municipality (we can advise on what may be needed)
- Make timely payment as agreed in your estimate or contract
- Notify us promptly of any concerns about the work in progress or upon completion
9. Limitation of Liability
- Molnar Roofing's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project giving rise to the claim
- We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of profit, or damage to interior property caused by pre-existing conditions
- We carry comprehensive general liability insurance and workers' compensation coverage. Proof of insurance is available upon request
- Our liability for damage to landscaping, driveways, or other property features is limited to reasonable restoration efforts. Some minor disturbance to the immediate work area is an inherent part of roofing work
10. Force Majeure
Molnar Roofing shall not be held liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to: severe weather events, natural disasters, pandemics, supply chain disruptions, material shortages, government orders or restrictions, labour disputes, or acts of vandalism or theft.
11. Website Use
- The information on our website is provided for general informational purposes only and does not constitute professional roofing advice for your specific situation
- We make reasonable efforts to keep website content accurate and current, but do not warrant that all information is complete, accurate, or up to date at all times
- You may not use our website for any unlawful purpose, to solicit others to perform unlawful acts, or to attempt to gain unauthorized access to our systems
- We reserve the right to modify, suspend, or discontinue any aspect of the website at any time without notice
12. Intellectual Property
All content on the Molnar Roofing website — including but not limited to text, graphics, logos, images, and code — is the property of Molnar Roofing or its licensors and is protected by Canadian copyright law. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission.
13. Dispute Resolution
- Step 1 — Direct communication: We believe most disputes can be resolved through open, honest conversation. Please contact us directly to discuss any concerns
- Step 2 — Mediation: If direct communication does not resolve the issue, both parties agree to attempt mediation through a mutually agreed-upon mediator in Yorkton, Saskatchewan, before pursuing legal action
- Step 3 — Legal proceedings: If mediation is unsuccessful, either party may pursue legal remedies through the courts of Saskatchewan. Both parties agree to the exclusive jurisdiction of the courts of the Province of Saskatchewan
14. Cancellation & Termination
- You may cancel a scheduled project at any time before work begins without penalty, provided materials have not yet been ordered or delivered
- If materials have been ordered or delivered, you are responsible for the cost of those materials plus any applicable restocking fees
- If you wish to cancel a project after work has commenced, you are responsible for payment of all work completed to date, plus materials costs
- Molnar Roofing reserves the right to terminate a project if the client fails to provide access, makes unreasonable demands that compromise safety, or fails to make agreed-upon payments
15. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms.
16. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
17. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Saskatchewan and the applicable federal laws of Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Saskatchewan.
